These Terms & Conditions (“Terms”) govern your access to and use of the website located at https://chefconniebakes.com (the “Site”), any related mobile or other interfaces, online ordering systems, email communications, and all products, services, content, and features offered by Chef Connie Bakes / Connie Akins Mullins (or the applicable operating entity) (“we,” “us,” “our,” or “Chef Connie Bakes”). By accessing the Site, placing an order, creating an account (if available), submitting content, or otherwise using any of our services, you agree to be bound by these Terms and our Privacy Policy (incorporated by reference). If you do not agree, do not use the Site or purchase our products.

### 1. Acceptance of Terms
By using the Site or purchasing products, you acknowledge that you have read, understood, and agree to these Terms in their entirety. We may require affirmative acceptance (for example, by checking a box during checkout or account creation). Continued use after any modification constitutes acceptance of the updated Terms. These Terms form a binding contract between you and Chef Connie Bakes.

### 2. User Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding contract to use the Site or purchase products. By using the Site, you represent and warrant that you meet these requirements. The Site and products are intended for personal, non-commercial use unless otherwise expressly authorized in writing. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if eligibility requirements are not met.

### 3. Products, Orders, and Availability
We offer handcrafted confections and baked goods, including Texas Gold (tempered Valrhona chocolate with peanut brittle shards and flaky sea salt), and may offer other limited-batch items, gift boxes, catering, or custom services. Products are made in small batches, often on a limited or seasonal basis, and availability is not guaranteed.

Orders may be placed online (if the ordering system is active) or via email to chef@chefconniebakes.com. All orders are subject to acceptance, product availability, and our confirmation. We may cancel or refuse any order for any reason, including suspected fraud, pricing errors, or supply limitations. Prices, descriptions, and images are subject to change without notice. You are responsible for providing accurate shipping/contact information. Risk of loss and title for products pass to you upon delivery to the carrier. Perishable food items may be affected by shipping conditions; we are not responsible for temperature excursions, delays, or spoilage after handoff to the carrier.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written permission. Recipes and proprietary methods (including Mama’s original peanut brittle recipe elements and Texas Gold formulation) remain our intellectual property. Trademarks may not be used without authorization.

### 6. User Content License
If the Site allows user submissions (comments, reviews, photos, recipes, testimonials, or other materials—“User Content”), you grant Chef Connie Bakes a worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your User Content in any media for any purpose, including marketing and promotion, without further compensation or attribution (unless required by law or we choose to attribute).

You represent that you own or have the necessary rights to the User Content and that it does not violate any third-party rights or applicable law. We may remove User Content at any time. You remain responsible for your User Content.

### 7. Disclaimers
THE SITE, PRODUCTS, AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

**Food-specific disclaimers**: Our products, including Texas Gold, contain peanuts (from peanut brittle) and may contain or come into contact with other common allergens (milk/dairy from chocolate, soy, wheat, tree nuts, or others depending on production). Products are made in a home or small-batch kitchen that is not certified allergen-free. We do not guarantee the absence of cross-contact. Always review ingredient information and consult a physician if you have allergies. Products are not intended to diagnose, treat, cure, or prevent any disease. Nutritional information, if provided, is approximate.

We do not warrant that the Site will be uninterrupted, error-free, or secure, or that defects will be corrected. Product appearance may vary due to handcrafting. Shipping of perishable items is at your risk.

### 8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHEF CONNIE BAKES, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, PERSONAL INJURY, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, PURCHASE OR CONSUMPTION OF PRODUCTS, OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PRODUCTS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU. YOU ASSUME ALL RISK RELATED TO THE CONSUMPTION OF FOOD PRODUCTS.

### 9. Indemnification
You agree to indemnify, defend, and hold harmless Chef Connie Bakes and its owners, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or products; (b) your violation of these Terms; (c) your User Content; (d) your violation of any law or third-party rights; or (e) any allergic reaction, illness, or injury claimed in connection with our products where you failed to heed allergen warnings or provided inaccurate information.

### 10. Account Termination
If accounts or user profiles are offered, we may suspend or terminate your access or account at any time, with or without notice, for any reason, including violation of these Terms, suspected fraud, or inactivity. Upon termination, your right to use the Site ceases immediately. We may retain data as required by law or for legitimate business purposes. You may stop using the Site at any time. Provisions that by their nature should survive (including IP, disclaimers, limitations of liability, indemnification, and governing law) will survive termination.

### 11. Governing Law
These Terms and any dispute arising out of or relating to them or the Site/products shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

### 12. Dispute Resolution
**Informal Resolution**: Before initiating formal proceedings, you agree to contact us at chef@chefconniebakes.com to attempt to resolve the dispute informally.

**Binding Individual Arbitration and Class Action Waiver**: Except for claims that qualify for small claims court or disputes involving intellectual property rights, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or products shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place in Tarrant County, Texas, or via telephone/videoconference as appropriate.

YOU AND CHEF CONNIE BAKES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of representative or class proceeding.

You may opt out of this arbitration provision by sending written notice to the contact address below within 30 days of first accepting these Terms. If any portion of this arbitration agreement is found unenforceable, the remainder shall remain in effect, except that the class action waiver shall be severable only if required by law.

Nothing in this section limits either party’s right to seek injunctive relief in court to protect intellectual property or prevent irreparable harm.

### 13. Modification Process
We reserve the right to modify these Terms at any time. Changes will be effective upon posting the revised Terms on the Site with an updated effective date, or as otherwise stated. For material changes, we may provide additional notice (e.g., via email or Site banner). Your continued use of the Site after the effective date of changes constitutes acceptance. It is your responsibility to review the Terms periodically. If you do not agree to modified Terms, you must discontinue use.

### 14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed. The remaining provisions shall continue in full force and effect.

### 15. Entire Agreement; Miscellaneous
These Terms, together with the Privacy Policy and any order-specific confirmations, constitute the entire agreement between you and Chef Connie Bakes regarding the subject matter and supersede all prior agreements. Our failure to enforce any right or provision shall not constitute a waiver. You may not assign these Terms without our consent; we may assign them freely. Headings are for convenience only. These Terms do not create any partnership, joint venture, or agency relationship.
